LODGING CONTRACT ENTERED INTO AS HOST:

ALEXIS JUÁREZ CAO ROMERO, natural person with voter's credential issued by the National Electoral Institute number: JRCAAL6804040521H101; who has Federal Taxpayers Registry: JUCA68040405AV4; and domicile located at:

Calle Costa Verde #5 Parque de la Castellana in Lomas de Angelopolis II, San Andres Cholula, 72830.

WHO WILL BE JOINTLY REFERRED TO AS "THE PARTIES"; EACH OF THE PARTIES ACKNOWLEDGING THAT THEY HAVE FULL CAPACITY TO BIND THEMSELVES, FIRST STATE THE FOLLOWING:

 

DECLARATIONS

I. THE HOSPITALITY PROVIDER declares that it has the infrastructure, its own elements, technical resources and trained personnel to comply with its obligations, in accordance with the provisions of this Contract.

II. That for the attention of doubts, clarifications, complaints or to provide orientation services, THE HOSPITAL PROVIDER indicates the following means of contact:

III. THE GUEST expresses its interest in contracting the lodging services offered by THE HOSPITALITY PROVIDER.

 

THE PARTIES being in agreement with the above, as well as knowing the content of the statements made above, which they ratify for containing the truth, and without any error, fraud, violence, bad faith or vice in the consent that could invalidate the same, they agree to submit to the following:

 

CLAUSES

CLAUSE ONE. OBJECT.

THE PARTIES state their willingness to enter into this Agreement, the legal nature of which is the provision of lodging services, whereby THE HOSPITALITY PROVIDER undertakes to make available to THE GUEST a space that will serve as a room for the latter, and which will have the following characteristics:

- Business Class/Grand Tourism Suite;         

- Wedding or anniversary suite;       

- Family suite for six people; 

- Room with double bed and shared bathroom with Jacuzzi-spa;  

- Room with double bed, sofa and bathroom with shared Jacuzzi-spa;     

- Student room with private bathroom;       

- Student room with shared bathroom;

Being located at the following address:

Calle Costa Verde #5 Parque de la Castellana in Lomas de Angelopolis II, San Andres Cholula, 72830.

 

CLAUSE TWO. PRICE OF THE SERVICE.

THE PARTIES agree that the total price to be paid by THE HOST, as consideration for the lodging service shall be the amount of $________ (________). Said amount includes all the amounts and concepts related to the lodging service; therefore, THE HOST undertakes to respect said cost at all times, without being able to charge any other amount or condition the provision of the contracted lodging service to the acquisition of any other service not required by THE HOST.

The total price for the lodging shall be paid in two payments, the first payment shall be made in advance to reserve the lodging and shall correspond to 50% (fifty percent) of the total price. The remaining percentage shall be paid at the beginning of the lodging.

 

THIRD CLAUSE. FORMS OF PAYMENT.

The payment of the lodging service may be made through deposit or bank transfer to the account identifiable with the following data:

In any case, THE HOST is obliged to issue and deliver to THE HOST the corresponding invoice, consumption note or fiscal document that covers the charges made for the provision of the lodging service.

 

CLAUSE FOUR. RECEPTION AND DEPARTURE FROM THE LODGING PLACE.

The lodging service shall begin on ________ at 13:00 hours and shall be concluded on ________ at 11:00 hours.

In case of need, THE GUEST may request THE HOSPITALITY GUARDIAN to extend the duration of the lodging service. This extension shall be made in writing and shall be included as an addendum to the present Lodging Agreement, specifying the duration and costs to be covered by the same.

 

CLAUSE FIVE. DELAY IN DEPARTURE.

If THE GUEST does not check out on the date and time indicated, and an extension of the present contract has not been made, he/she shall pay THE HOST as a conventional penalty the amount of $300 (three hundred pesos 00/100 Mexican Pesos).

 

CLAUSE SIX. USE OF THE SPACE FOR LODGING.

The use of the space contracted for the lodging service shall be reserved solely and exclusively for THE HOST and the persons indicated in the declarations of this contract.

It is forbidden to bring guests into the property without authorization from THE HOSPITALITY PROVIDER.

 

SEVENTH CLAUSE. CONDITIONS AND MAINTENANCE OF THE SPACE DESTINED TO THE LODGING.

THE HOST shall be obliged to deliver the space destined to the lodging service in hygienic and safe conditions, sufficient and necessary to be habitable, and shall have adequate electricity, water and drainage facilities.

In the event that the guest should cause any damage to the property, the guest shall be obliged to cover the repair costs incurred.

The cleaning of the space destined to the lodging service will correspond to the guest.

 

EIGHTH CLAUSE. SERVICES INCLUDED.

The price established in the second clause of this contract shall cover, in addition to the lodging, the following services:

Wifi, access to common areas, use of the kitchen, cooking accessories and eating utensils, parking.

Any additional service not included in this contract must be agreed upon and paid for separately.

 

CLAUSE NINE. RULES AND REGULATIONS.

THE PARTIES agree that the use of the space destined to the lodging service and of the facilities of the building in which it is located shall be subject to the provisions of the Internal Regulations, which, in accordance with the legal provisions, shall be located in a visible place in the room or space destined to the lodging of THE GUEST.

 

TENTH CLAUSE. OBLIGATIONS OF THE PARTIES.

THE GUEST shall be obliged to:

I. Comply with the provisions of this Contract.

II. Provide the necessary information requested by THE HOSPITAL PROVIDER in connection with this Contract.

III. Inform THE HUESSPED of the prices, rates, conditions, characteristics and total cost of the lodging service that is the object of this Contract.

IV. Inform THE HUESSPED of any restriction or prohibition that applies within the place of lodging in order to make it effective.

THE HOSPITALITY STAYER shall be obliged to:

I. Comply with the provisions of this Contract.

II. Make payments in accordance with the stipulations of this Contract.

III. To respect and to make that its companions obey the established in the Regulations of the lodging place.

 

CLAUSE ELEVENTH. CAUSES FOR TERMINATION.

The following shall be causes for termination of this contract:

I. That any of the parties does not comply with the stipulations of the present contract.

II. If THE HOSPITALITY PROVIDER intends to make charges not agreed upon or requested by THE HOSPITALITY PROVIDER.

III. That the lodging service does not correspond to what was agreed and/or requested by THE HOSPITALITY PROVIDER.

IV. That THE HOSPITALITY HOLDER violates the provisions set forth in the Regulations.

V. That THE HOSPITAL having reserved the lodging service, requests its cancellation after one day has elapsed from the date on which the reservation was requested.

In the event of termination of this Contract, the defaulting party shall pay to the affected party a conventional penalty equivalent to $1,500 (one thousand five hundred pesos 00/100 Mexican Pesos) on the total price of the lodging service.

 

CLAUSE TWELFTH CLAUSE. NON-PAYMENT.

In case THE HOSPITALITY PROVIDER does not have enough money to cover the total cost of the lodging or generates any damage to the property and there is no way to pay it, according to the provisions of Article 2669 of the Federal Civil Code, and its correlatives in the Local Codes, THE HOSPITALITY PROVIDER may retain THE HOSPITALITY PROVIDER'S luggage until it obtains the payment of what is owed.

CLAUSE THIRTEENTH. PRIVACY OF THE CONTRACT.

THE PARTIES agree that this Agreement is of a private nature, and therefore, they shall refrain from communicating its content to a third party or making it public, nor shall they disclose, share or misuse the data provided by THE PARTIES to enter into the agreement, however, all the rights and obligations of THE PARTIES shall prevail, and therefore all the legal actions arising from the same may be exercised in accordance with the Law.

In addition to the foregoing and in accordance with the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, THE HOSPITAL PROVIDER shall inform THE HOSPITAL PROVIDER of the privacy notice as well as the procedure to exercise the rights of access, rectification, cancellation and opposition to the processing of personal data ("ARCO" rights).

 

CLAUSE FOURTEEN. JURISDICTION.

For all matters relating to the interpretation and fulfillment of the obligations arising from this agreement, the parties agree to submit to the jurisdiction and competence of the Courts and Tribunals that according to law must hear the matter due to the place where the agreement is signed, waiving their own jurisdiction in case it applies to them and is appropriate by reason of domicile, neighborhood, or any other nature.

 

Having read the present agreement and having been informed of its content and legal scope, the parties sign it by mutual agreement in San Andres Cholula, Puebla on May 8, 2023.
